Mr Ram Dass an Indian National Released from Kot Lakphat Prison after 10 years

On Thursday 11th of July 2013 Mr. Ram Dass an Indian national was released from Kot Lakphat Prison in Pakistan (the same prison in which the late Mr. Sarabjit Singh was incarcerated in). 

I understand that the Indian prisoners released along with Mr. Ram Dass disclosed that Mr. Ram Dass was in Kot Lakphat Prison Pakistan for 10 years during which he was tortured. Mr. Ram Dass lacks mental capacity believed to be as a result of the torture and abuse he suffered during his detention in prison. Mr. Ram Dass did not receive any medical treatment throughout the duration of his detention. Sadly, he is not in a position to confirm details of his family or address in India. No one turned up to collect him when he reached the Red Cross Centre in Amritsar Punjab India.

Further, the Pakistani authorities have failed to provide an explanation or details of his crime, arrest, conviction or sentence.

Mr. Dass's plight has been featured in a local news report in the hope that it is picked by the national press so that his family can come forward to collect him.

Knowing what I know of the Indian authorities from previous cases, they would not have de-briefed, medically examined, assessed or treated these prisoners, let alone provide them with counseling. I would be extremely surprised if the Pakistani informed the Indian authorities of Mr. Dass's detention. Equally, I would be interested to know what attempts were made by the Indian authorities to ascertain the details of Indian nationals detained in Pakistani prisons. I fear that the Indian Government did not make any attempts to secure the release of these prisoners or indeed ensured that they had access to Consular services and legal advice.

I have previously asked the Red Cross whether to visit the Indian prisoners in Pakistani prisons. I was informed that they do not have “permission “to visit certain prisons in Pakistan. If this is indeed correct then it is of course is contrary to the international communities’ mandate given to the Red Cross under the Geneva Conventions which authorises them to visit these prisoners.

I am aware of other cases of vulnerable prisoners unlawfully detained in Pakistani prisons - including a 15 year old Indian boy who has been in the unlawful custody of the Pakistani authorities for the last 9 years and continuing.

Despite having repeatedly drawn these cases of gross human rights abuses to the attention of the international human rights organisations such as the UN, Amnesty International and Human Rights Watch, they have failed to intervene thus allowing Pakistan to continue to abuse and torture with impunity.

Mr. Dass's case and the details of the other Indian nationals released by the Pakistani authorities on Thursday 11th of July 2013 were reported in the local press in Amritsar Punjab India. These reports are written in Hindi and Punjabi and are rarely picked up by the English press and therefore fail to reach the media in the West.

Missing Indian National - Hamid Nehal Ansari - Believed to be in Pakistan

Hamid Nehal Ansari, an engineer studying for his MBA from Mumbai worked as a lecturer at the Management College in Mumbai until October 2012.

Hamid was the President of the Rotaract Club Mumbai in 2012 and actively worked for and believed in the betterment of the life the less advantage through education.

Hamid decided to pursue an alternative career in aviation and lined up a job interview in Kabul Afghanistan. He travelled to Kabul on the 4th of November 2012 and was due to return to India on the 15th of November 2012 but failed to do.

Hamid's parents Mr Nehal Ansari and Mrs Fauzia Ansari desperately tried to establish contact with Hamid but failed to do so. They have contacted Hamid's friends and contacts in Kabul who claim that they do not know the whereabouts of Hamid.

On behalf of Mr and Mrs Ansari, I appeal to Hamid or anyone who knows Hamid to contact Mr and Mrs Ansari immediately via this blog link. Mrs Ansari is extremely distraught not knowing where Hamid is having not heard from him for over six months.

It is believed that Hamid  crossed over into Pakistan encouraged by his friends and contacts in Pakistan. Active attempts are being made by the Government of India to ascertain the whereabouts of Hamid.

Mr Chamel Singh, Indian National - Death in Custody- Pakistan

Mr Chamel Singh's body was handed to his family at the Attari Border, Amritsar Punjab India on Wednesday 13th of March 2013

Mr Chamel Singh an Indian national aged 40 from Jammu Kashmir, was serving a five year prison sentence in Kot Lakphat Prison in Lahore Pakistan (the same prison as Mr Sarabjit Singh:www.freesarabjitsingh.com) following yet another dubious conviction for "spying" on behalf of India.

On Tuesday 15th of January 2013, following a heated verbal exchange between Mr Chamel Singh and two of the prison wardens, it is alleged that Mr Chamel Singh was seriously physically assaulted by the prison wardens. It is further claimed that other senior prison officials joined in the attack on Mr Chamel Singh. This incident was witnessed and highlighted by Mr Tahseem Khan an advocate and president of a Pakistan based NGO 'Jesus Rescues'. Mr Khan said that he was imprisoned for highlighting arson attacks on churches in Pakistan. Mr Khan was released on the 18th of January 2013.

It is maintained that Mr Chamel Singh passed away on the Tuesday 15th of January 2013 following the injuries he sustained. His body was moved to Jinnah Hospital, Lahore.

Mr Chamel Singh's distraught family pleaded to both the Indian and Pakistani authorities relentlessly to release and return Mr Chamel Singh's body to his family so that they could attend to his cremation. A post mortem was also requested.

Mr Chamel Singh's body remained at Jinnah Hospital from the date of his death, 15th of January 2013 until Wednesday 15th of March 2013 when it was eventually repatriated to his family in India via Attari Border in Amritsar Punjab. That is after two months to the day from the date of Mr Chamel Singh's death.

I understand that Pakistani authorities did undertake a post mortem. Mr Chamel Singh's family have not yet received a copy of the post mortem report. I have advised them to ensure they arrange for a further post mortem and for the injuries to be photographed before they attend to cremating the body.

The prison officials were not suspended as one would expect following a serious incident such a death in custody. To date the perpetrators have not been arrested.

Mr Rehman Malik, the Interior of Minister of Pakistan in his response to my message on Twitter said that he had ordered an Inquiry. The outcome of which is yet to be made public - assuming an Inquiry did take place and that the announcement in the media was not merely a sound bite.

The incident yet again questions the treatment of Indian prisons detained in Pakistan. I am aware that despite the Red Cross's mandate under the Geneva Conventions 1949 and under the supporting Protocols, granting Red Cross access to foreign prisoners to establish their welfare, the Red Cross has been denied access to a number of prisons in Pakistan. This has not been questioned by the international community.

Captain Sanjeet Bhattacharjee and Lance Naik Ram Bahadur Thapa Indian Officers Captured and Unlawfully Detained in Pakistan

Captain Sanjeet Bhattacharjee SS-3527/W of 7/8 Gorkha Rifles, Indian Army together with Lance 5752458A Naik Ram Bahadur Thapa were captured by the Pakistani security forces on the 14th of April 1997 whilst undertaking an operational reconnaissance with the rest of the platoon at the International Border, Bhoj in Gujrat.

Witness and intelligence evidence indicates that on the 28th of April 1997 that two Indian Officers were taken to an interrogation Centre based on the outskirts of Hyderabad/Karachi by Major Khiyani and Captain Umar.

The Indian Government formally contacted the Government of Pakistan in relation to the capture of Captain Sanjeet Bhattacharjee and Lance Naik Ram Bahadur Thapa. The Pakistani authorities failed to acknowledge the correspondence from the Indian Government in relation to these two and other Indian missing Officers.

After just over five years after Captain  Sanjeet Bhattacharjee and Lance Naik Ram Bahadur Thapa's disappearance, and after minimal effort by the Indian Government to ascertain their whereabouts, the Indian Government declared both Captain Sanjeet Bhattacharjee and Lance Naik Ram Bahadur Thapa "dead" and proceeded to close their respective files. The failure by the successive Indian Governments to confront the Pakistani authorities and forcing them to account is is of course a gross dereliction of duty which allows the Pakistani authorities to continue to breach international laws and human rights without impunity.
